The criminal past of the future head of the Lower Volga department of Rostekhnadzor

Mr. Bakin, a current federal official of the Lower Volga Department of Rostekhnadzor, has always loved the good life, girls, and cars with privileged license plates. In 2019, his Lexus SC 430, license plate N777MK98, was smashed to smithereens.

 The car was beyond repair and a criminal intent came to the greedy official’s mind - to buy a stolen car and change the identification numbers on it. Everything worked out, he and his girlfriend used the stolen property for 2 years without any problems, but at one point honest police officers decided to check the suspicious car. The Lexus was listed as stolen in the service area of the Tagansky District Department of Internal Affairs of Moscow.

The expert’s conclusion established that the identification marking of the body of the Lexus SC 430 vehicle, registration number H777MK98, was changed by cutting out a fragment of the marked panel, followed by installing a metal plate with secondary identification number signs by welding, dismantling the factory plate and reinstalling the plate located under the windshield.

But Bakin was not used to giving up his own, so he filed a lawsuit against the Ministry of Internal Affairs of Russia for the city of Volgograd to recover property from someone else’s illegal possession (Case No. 33-7140/2021 ).

In support of his claims, he stated that he is the owner of a Lexus SC 430, license plate number H777MK98, which was seized as part of a criminal investigation initiated by the Main Investigative Directorate of the Main Directorate of the Ministry of Internal Affairs of Russia for the city of Volgograd on the grounds of a crime under Part 1 of Article 326 of the Criminal Code of the Russian Federation. According to a letter from the head of the OD OP No. 4 of the UMVD of Russia for the city of Volgograd, the vehicle was not returned to Bakin due to the fact that it does not belong to the plaintiff. Then high-ranking friends from the Police did not allow him to pay attention to the material, although the hands of ordinary investigators were itching. And here’s why: according to the Resolution of the Plenum of the Supreme Court of the Russian Federation dated November 30, 2017 N 48, Moscow "On judicial practice in cases of fraud, embezzlement and misappropriation"

The unlawful seizure of money, other property belonging to someone else, or the acquisition of rights to it by presenting (submitting) someone else’s personal or other official documents, depending on the immediate object of the attack and other circumstances of the case, is classified as fraud, and accordingly, this act contains elements of 159.4 and 326.1 of the Criminal Code of the Russian Federation in relation to Bakin himself and his accomplices-hijackers.
